WHO IS ELIGIBLE FOR BENEFITS?

You are eligible for the benefits described in this plan summary if you are a full-time hourly or salaried employee of Vought Aircraft Industries who is a United States citizen or legal resident and you are not covered by a bargaining agreement.

Note: Certain part-time employees also are eligible for benefits. Check with your site’s Human Resources or Benefits representative for eligibility requirements or call the Vought Benefits Center, 1-866-689-5999 .

You are not eligible for the benefits described in this plan summary if you are:

  • A temporary employee
  • An independent contractor
  • An individual working as a contractor through an agency (an employee who is called a"job shopper," "contract employee," or "leased employee")
  • Someone who is not reported on Vought Aircraft payroll records as an employee.

WHO IS AN ELIGIBLE DEPENDENT?

If you are eligible for the Vought Benefits Program, you also may cover your eligible dependents under the program.

Eligible dependents include:

  • Your legally recognized spouse:
    • This definition does not include your legally separated or divorced spouse, even if the separation agreement or divorce decree states that coverage must be provided. If the court orders you to provide coverage for your legally separated or divorced spouse, you must arrange for coverage on your own.
    • This definition does include your common-law spouse if your state recognizes common-law marriage and you provide a Declaration of Informal Marriage or a common-law affidavit to the company.
  • Your children, including:
    • Your natural and adopted children, regardless of where they live
    • Stepchildren who live with you in a regular parent-child relationship
    • Children under age 18 who are placed with you for adoption
    • Children for whom you have legal guardianship issued by a court of law
    • A minor child who qualifies as a dependent under the Internal Revenue Code. Your child must be unmarried and under age 19, or under age 25 and a full-time student. (Note: Your child must be at least 14 days old to be eligible for dependent life insurance.)

FULL-TIME STUDENT STATUS

Your child is considered a full-time student if he or she is enrolled in at least twelve hours of a regular curriculum that leads to a diploma or degree at an accredited high school, technical school, college, or university. A temporary reduction in credit hours after the semester starts does not result in a change in status unless your child is no longer enrolled in a qualified program, as described here. Your child is considered a full-time student if he or she was enrolled for the prior semester, unless your child secures a full-time permanent job, gets married, does not enroll when school resumes, or is no longer supported by you.

Eligible dependents do not include anyone who is a member of the armed forces of any country, including the United States Armed Services.

Disabled Dependents

If you are eligible for Vought Benefits, you also may cover eligible disabled children as dependents. To be eligible for coverage past age 19, if a full-time student, or past age 25, your disabled dependent must meet all of the following conditions:

  • Your child was covered or eligible for coverage under the Vought Aircraft medical plan while under age 19
  • Your child's disability must have occurred before age 19, or while covered as a full-time student under age 25
  • Your child is unmarried and unable to earn a living because of a mental or physical handicap
  • Your child is fully dependent on you for financial support.

A disabled dependent is not covered unless all of the above conditions are met.

WORKING SPOUSES

If Both You and Your Spouse Work for Vought Aircraft Industries, Inc. or Certain of its Subsidiaries

If you and your spouse work at Vought Aircraft, one spouse can opt out of medical and dental coverage and the other spouse can cover both of you. Or, each spouse can elect separate coverage. However, only one spouse can cover your eligible dependents for medical and dental benefits. Both employees may cover eligible dependents for optional benefits, such as optional life and AD&D insurance.

If Your Spouse Works for a Company Other Than Vought Aircraft Industries, Inc. or Certain of its Subsidiaries

In many instances, the spouse of a Vought Aircraft employee has the opportunity to enroll for group health care coverage through his or her employer. If your spouse's employer pays 50% or more of the cost of health care coverage, Vought Aircraft requires your spouse to enroll in that plan before your spouse can be covered under this plan. This rule applies even if your spouse's employer offers only one option, such as a health maintenance organization.

With dual coverage, your spouse’s health care plan pays benefits for his or her expenses first, and then Vought Aircraft pays benefits.

Coverage by a medical care plan through the other employer does not prevent your spouse, as your covered dependent, from using your Vought Aircraft Industries, Inc. medical plan. However, the claim for your spouse’s medical care must first be submitted to his or her employer’s plan as the primary payer. Once you receive an explanation of benefits (EOB) from your spouse's plan (reflecting either the amount of payment or a denial), you can submit the EOB along with your claim to your Vought Aircraft benefit claims administrator for reimbursement as a secondary payer.

For example, if your spouse's plan is an HMO but your spouse goes to a non-HMO doctor, in most cases the HMO would deny the claim. However, you can submit both the claim and the EOB (which shows that your claim was denied by the HMO) to your Vought Aircraft Industries, Inc. medical plan provider for reimbursement.

If You Are an Active Employee and Your Spouse Is a Retiree of Vought Aircraft Industries, Inc. or Certain of its Subsidiaries

In such a case, you have three options for covering your retired spouse:

  • While you are an active employee, your spouse may be covered as your dependent under your medical and dental plan options.
  • If you choose, you can waive coverage and your spouse can cover you as a dependent under one of the retiree medical plan options, if available.
  • You can be covered under your medical and dental plan options and your spouse can be covered under his or her retiree medical plan option. Note: There may be some exceptions. Call the Vought Benefits Center if you have questions.

You and your spouse can be covered by only one Vought Aircraft Industries, Inc. medical plan each.

If You Are an Active Employee and Your Spouse Is a Retiree of Another Company

The chart below illustrates how your spouse's benefits are paid if:

  • Your spouse is retired
  • You enroll your spouse as a dependent under your Vought Benefits medical plan option
  • Your spouse enrolls in his or her company's retiree medical plan, if any.

ELIGIBILITY IN SPECIAL SITUATIONS

If You Are Rehired or Recalled by Vought Aircraft

If you are rehired and you return to Vought Aircraft employment, or if you are recalled and return to work after being terminated for lack of work or a reduction in the work force, you will be asked to re-enroll for benefits.

If you return within the same benefit plan year, the amount that you paid toward your deductibles is credited to you. In addition, any amounts paid by the plan toward your annual or lifetime maximums are counted toward these limits. If you are rehired or recalled during a subsequent benefit plan year, your deductibles for the new plan year start over. However, any amounts paid by the plan prior to your termination still apply to your lifetime maximums.

If You Are on a Temporary Off-Site Assignment

Your assignment is considered temporary if it lasts less than six months. When your domestic or foreign country temporary assignment begins, call the Vought Benefits Center, 1-866-689-5999 . A representative will research your situation and give you information on how your benefits are affected and how to submit claims.

If You Transfer from Your Medical Plan Provider’s Service Area

If you transfer from your medical plan provider’s service area, you will receive a benefit package based on your new ZIP code. You and your family may then select new health care benefits based on your new address of record. When you move, it is important that you:

  • Complete an address change form, available on the Download Forms page, or call the Vought Benefits Center and request a form
  • Send the completed form to Payroll

When the Benefits Center has your new address, you will be mailed materials for
benefits elections at your new location.

If Your Dependent Lives Out of Your Provider’s Service Area

You might have eligible dependents living away from home, such as a child who is away at college. Here are the rules for coverage of those dependents:

  • HMO – In general, if you participate in an HMO, your dependent must participate in the network that you elect. Your dependent in most cases is entitled only to emergency coverage while living outside the home service area, or in some cases out-of-network. Your dependent’s Primary Care Physician should conduct all regularly scheduled or preventive exams.
  • PPO – If you elect one of the preferred provider organization (PPO) options, your dependents can visit a physician in the PPO network anywhere in the nation and receive reimbursement at the higher in-network benefit level (90%).
    If your dependents receive care from an out-of-network provider, reimbursement will be paid at the out-of-network level (60% for Balanced Choice).

If You Are on Leave from Vought Aircraft

While you are on leave from the company, you are required to continue to contribute for certain benefits. You can contribute through automatic payroll deductions if you are receiving a paycheck. If you are not receiving a paycheck while on leave, you may pay for your benefits by writing a personal check to Vought Aircraft and sending it to the Payroll Department, Vought Aircraft, M/S 49L-44, P.O. Box 655907, Dallas, TX 75265-5907.

Failure to make these payments will result in loss of coverage.
